Terms of Service

These Terms of Service (“Terms”) govern your use of the Cipher mobile application (“Cipher”, “the app”, “the Service”) operated by Cipher Tracker LLC (“we”, “us”, “our”), a limited liability company registered in the State of Illinois.
By downloading, installing, or using Cipher, you agree to these Terms. If you don't agree, don't use the app.
1. Who Can Use Cipher
Cipher is intended for users who are 18 years of age or older. The app includes features for tracking alcohol, cannabis, nicotine, and other substances, and is not designed for minors.
By using Cipher, you confirm that you are at least 18 years old. We do not knowingly collect data from anyone under 18. If we learn that a minor has used the app, we will take steps to remove their data.
2. What Cipher Is (And Isn't)
Cipher is a personal tracking tool. It helps you log habits, health data, and wellness information for your own reference.
Cipher is not a medical device, a medical service, or a substitute for professional medical advice. The app does not diagnose, treat, cure, or prevent any disease or medical condition.
Specifically:
- •Medication tracking in Cipher (including prescription scheduling and dosage logging) is for personal organization only. It does not replace a pharmacist's or doctor's instructions. Always follow your healthcare provider's guidance for medication use.
- •Menstrual cycle predictions and phase calculations are estimates based on your logged data. They are not reliable for medical decisions, family planning, or contraception.
- •Exercise tracking, calorie counting, and nutritional information are approximate. Calorie data from our food database may not be perfectly accurate for every product or serving size.
- •Sleep, substance, and screen time data reflect what you manually enter or what your device reports. We make no guarantees about the accuracy of device-reported data.
You should not make health decisions based solely on information from Cipher. If you have concerns about your health, talk to a doctor.
3. Your Account and Password
When you set up Cipher, you create a password that generates your encryption key. This is the only way to access your data.
You are responsible for:
- •Keeping your password safe
- •Remembering your password
- •Any activity that occurs under your account
We cannot recover your password or your data if you forget your password. This is by design — your data is encrypted with a key derived from your password, and we do not store your password anywhere. If you lose it, your data is permanently inaccessible. We are not liable for any data loss resulting from a forgotten password.
If you set up a PIN for daily access, the PIN protects local access to the app but does not replace your password.
4. Subscriptions and Payment
Cipher offers both free and paid tiers.
Free tier: Access to one tracker of your choice.
Paid subscriptions: Access to all trackers, full analytics, and all features. Available as monthly, yearly, or lifetime plans.
All payments are processed through Apple (App Store) or Google (Google Play). We do not handle your payment information directly. Subscription terms:
- •Subscriptions auto-renew unless you turn off auto-renewal at least 24 hours before the current period ends.
- •You manage subscriptions and cancellation through your Apple ID or Google Play account settings — not through Cipher.
- •Refunds are handled by Apple or Google according to their respective refund policies. We cannot process refunds directly.
- •“Lifetime” means the lifetime of the Service, not the lifetime of the subscriber. If Cipher ceases to operate, lifetime subscriptions end with it.
- •If your subscription expires or is canceled, your access reverts to the free tier. Your data is not deleted — it remains encrypted on our servers and accessible if you resubscribe.
5. Your Data and Privacy
Our Privacy Policy at cipher-app.org/privacy explains how we handle your data. By using Cipher, you also agree to the Privacy Policy.
The short version: your tracker data is encrypted on your device before it reaches our servers. We cannot read it.
6. How You Can Use Cipher
We grant you a limited, non-exclusive, non-transferable, revocable license to use Cipher for your personal, non-commercial use.
You agree not to:
- •Copy, modify, distribute, or reverse-engineer the app or any part of it
- •Use the app for any unlawful purpose
- •Attempt to access other users' data or interfere with the Service
- •Use automated systems (bots, scrapers) to access the Service
- •Misrepresent your identity or impersonate another person
- •Use Cipher to develop a competing product
7. Intellectual Property
Cipher, its design, code, icons, and content are owned by Cipher Tracker LLC. All rights reserved. These Terms don't give you any ownership rights in the app or its content.
Nutritional data displayed in the Calorie tracker is provided by a third-party database and is subject to their terms. Exercise instruction images are sourced from the Free Exercise DB (public domain).
Your tracker data belongs to you. We claim no ownership over data you enter into the app.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- •The Service will be uninterrupted, timely, secure, or error-free
- •The results obtained from the Service will be accurate or reliable
- •Any errors in the Service will be corrected
- •Notifications, reminders, or alerts will be delivered reliably
- •The food database, nutritional information, or barcode data will be accurate
- •Cycle predictions or health estimates will be correct
You use the Service entirely at your own risk.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Cipher Tracker LLC, its owner, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- •Loss of data (including encrypted data that cannot be recovered due to a forgotten password)
- •Loss of profits, goodwill, or business opportunities
- •Personal injury or health consequences arising from your use of or reliance on the Service
- •Missed medications, incorrect dosage information, or prescription tracking errors
- •Health decisions made based on data displayed in the app
- •Injuries sustained during exercise tracked or suggested by the app
- •Inaccurate nutritional information from third-party food databases
- •Damage arising from unauthorized access to your account
- •Service interruptions, bugs, or data sync failures
In no event shall our total liability to you for all claims exceed the amount you paid to us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless Cipher Tracker LLC, its owner, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising out of or in any way connected with:
- •Your use of the Service
- •Your violation of these Terms
- •Your violation of any third-party rights
- •Any health decisions you make based on data from the Service
- •Any content or data you submit through the Service
11. Third-Party Services
Cipher uses third-party services for:
- •Encrypted data storage and sync
- •Subscription management
- •Food and nutrition data
- •In-app purchases (Apple / Google)
We are not responsible for the availability, accuracy, or conduct of third-party services. Your use of these services is subject to their own terms and policies.
12. Termination
We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. Reasons may include violation of these Terms, abuse of the Service, or discontinuation of the Service.
You may stop using Cipher at any time. You can delete all your data from within the app through Settings. Deletion is permanent and cannot be undone.
Upon termination, your right to use the Service ends immediately. Sections of these Terms that by their nature should survive termination will survive, including Sections 8, 9, 10, and 14.
13. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will update the “Last updated” date at the top of this page. For significant changes, we will make reasonable efforts to notify you through the app.
Your continued use of Cipher after changes are posted means you accept the updated Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to conflict of law principles.
Any disputes arising under these Terms shall be resolved in the state or federal courts located in Illinois. You consent to the jurisdiction of such courts.
15. General
- •If any provision of these Terms is found to be unenforceable, the remaining provisions stay in effect.
- •Our failure to enforce any right or provision does not waive that right.
- •These Terms, along with the Privacy Policy, constitute the entire agreement between you and Cipher Tracker LLC regarding the Service.
- •You may not assign or transfer your rights under these Terms. We may assign our rights without restriction.
